1. Acceptance of Terms

By accessing or using MosaicQR at mosaicqr.com (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MosaicQR is a web application that generates branded QR codes. You upload a reference image and provide a destination URL, and the Service generates a QR code incorporating your reference image. Free usage is limited to watermarked `v14` QR codes. A Pro subscription currently costs $9 per month and unlocks watermark-free downloads, custom reference image uploads, and QR versions from `v3` through `v28`. MosaicQR uses patent-pending mosaic QR technology.

3. User Responsibilities

  • You must have the right to use any logo or image you upload. You are solely responsible for ensuring you have the necessary rights, licenses, or permissions for any content you submit.
  • You must not upload content that is illegal, infringing, defamatory, obscene, or otherwise objectionable.
  • You must not use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • You must not attempt to interfere with, compromise, or disrupt the Service or its infrastructure.

4. Intellectual Property

You retain all rights to the logo images you upload and the QR codes generated from them. MosaicQR does not claim any ownership over your content.

The MosaicQR name, branding, website design, and underlying technology are the intellectual property of MosaicQR and may not be copied, modified, or distributed without our written permission.

5. Payments and Refunds

  • Pro is a recurring subscription billed at $9 per month and processed securely through Stripe.
  • You can manage cancellation and billing details through the Stripe customer portal.
  • Subscription charges are non-refundable. If you experience a technical issue with the Service, please contact us at contact@mosaicqr.com.

6. Data and Storage

Uploaded images and generated QR codes are stored temporarily with a 24-hour time-to-live and are automatically deleted after that period. We do not maintain long-term archives of your content. For full details on how we handle your data, please see our Privacy Policy.

7. Service Availability

We strive to keep MosaicQR available at all times, but we do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable for any loss or inconvenience caused by service interruptions.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that QR codes generated by the Service will be scannable on any particular device or under any particular conditions. It is your responsibility to verify that any generated QR code scans correctly before printing, distributing, deploying, or otherwise relying on it.

9. Why Codes May Not Scan

MosaicQR uses an algorithm tuned through extensive testing to maximize scannability while preserving the visual likeness of your reference image. In our testing, the large majority of generated codes scan reliably on modern smartphones under normal conditions.

Some codes may not scan at all. Because MosaicQR shapes each code to resemble your reference image, certain combinations of image geometry, contrast, and color can produce codes that fail to scan even on modern iPhones and Android devices under ideal conditions. A code may also scan on iPhones but not Androids, or vice versa — the two platforms use different scanning algorithms and tolerances. If a code doesn’t scan, try a different reference image, a different size, or regenerate.

Scannability also depends on factors outside our control: the scanning device and app, lighting, print quality, code size, contrast with surrounding materials, and viewing angle. Older phones and dedicated barcode scanners may have lower success rates.

Always test every code on iPhone and Android, and any other intended scanning devices before printing or deploying it.

10. Limitation of Liability

To the fullest extent permitted by law, MosaicQR and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

11. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated “Last updated” date. For material changes, including changes to the arbitration clause, we will provide reasonable notice (for example, by email to registered users or a notice on the Service) before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.

13. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

13.1 Agreement to Arbitrate

You and MosaicQR agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.2 Arbitration Rules

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or remotely by video conference at your option. The arbitrator’s decision shall be final and binding.

13.3 Class Action Waiver

You and MosaicQR agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

13.4 Jury Trial Waiver

You and MosaicQR waive any right to a trial by jury in any action or proceeding arising out of or relating to these Terms or the Service.
